GetAride Rider Terms & Conditions

Overview

 

GetAride is a web-based E-hailing solution for ordering a transportation; it communicates transportation service requests to the transportation service providers who have been registered as users of the GetAride system. The private limited company GetAride Limited  (CAC RC No 1459084) is a subsidiary of Getittome Africa Concept Ltd, both founded in the Federal Republic of Nigeria, and are the holder of rights and service provider of the GetAride app.

 

When you book a journey with GetAride you agree to use the GetAride website and mobile application(s) to book and then pay the full cost of your journey to GetAride. Your use of the GetAride mobile application(s), and/or website indicates that you agree to the Terms and Conditions below.

 

GetAride is not a licensed private hire operator. GetAride Limited is acting as a Booking Agent.

If you would like to cancel your booking request for a Taxi Service, you can do so at any time before you begin your journey by informing the Driver through the applicable functionality available on the Service. If you cancel your booking request more than 5 minutes after it was accepted by a Driver, we may charge you an administration fee on behalf of the Driver.

 

Definitions and interpretation

 

 

Limitations on Use of Software

 

The E-hailing Software provided by the Company and used by you in order to make a booking remains at all times the property of the Company and is considered Confidential Information. You warrant that no copyrighted details of either the Mobile or Web applications will be passed on to Third Parties at any time.

Warranties

 

You guarantee that you have authority to enter into this agreement and to use our software in accordance with the terms and conditions of this agreement. You agree to be financially responsible for all of your use of our software as well as for the use of your name and payment method (e.g. corporate credit card, personal credit card, or other approved method) to pay for services and products purchased using our Software or Site by members of your household, including minors living with you, and if you have administrative roles with your employer for which you create bookings for colleagues, such colleagues. You also warrant that all information supplied by you or members of your company, organisation or household in using our Site or Software is true and accurate. You agree to indemnify us for any breaches of the foregoing warranties.

Terms of Service

General

Our Software is to be used to get quotes and then make bookings and payments for Private Ride. Once the booking is confirmed you will then be subject to this terms and conditions.

Payments

Once you have received a booking confirmation from GetAride Limited:

 

Promotional Vouchers

From time to time GetAride may offer customers promotional or customer service vouchers which can be used as credit against the cost of journeys. These will typically be valid for a set time (e.g. two weeks) and specific limits will be communicated as part of voucher distribution where possible. For the avoidance of doubt, GetAride reserves the right to end the validity of any vouchers without prior notice, although such notice (period of validity and other terms) will always be given where possible. To use vouchers against journeys of greater value than the voucher balance a customer will be required to add additional funds to their GetAride prepaid account to cover the difference.

 

 

Extras

Extras are any additional charges that may occur once the journey has been booked. These may include the following:

Any extras that have occurred on a cash booking will need to be paid directly to the driver. For extras on a journey which has been paid for with either a debit/credit card or pre-paid account the amount will be debited from the card or pre-paid account.

 

 

GetAride Support

 

 

Price Displayed for Booking

Useage of our our E-hailing app is free you do not need to pay us to use the Service. except , where the Driver instructs us to do so, we  will collect Fares as payment agent for the Driver, together with any other amounts (such as cancellation fees or waiting fees) agreed between you and the Driver

The quote displayed to you when you make your booking is the journey price excluding any extras. we will calculate the Fare on behalf of the Driver based on the details of the Taxi Service provided to you (such as journey times and distance).

 

Payment Failure

If after using our service we are unable to get payment from your card we would suspend /terminate service to you and we shall be under no obligation to provide any or all of the Service while the amount concerned is unpaid

 

Payment of Cancellation Fees

If a cash booking is cancelled leading to a cancellation fee the amount will be deducted from your pre-paid account (should you have one). If you do not have a pre-paid account the amount will be logged as a negative balance on your account and you will not be able to make any further bookings through GetAride until the negative balance has been settled.

If a booking is made using a credit or debit card and then cancelled, leading to a cancellation fee as defined above, GetAride Limited will charge your credit card or your account the cancellation fee.

 

 

Refund Policy

In the event of any situations arising that lead to a request for a customer refund, GetAride will address these issues and liaise with the relevant fleet in order to determine the customer’s entitlement and then update the customers by email and or phone. GetAride can be contacted at support@getaride.ng for any refund related issues.

 

Resolving disputes

Should you have a dispute with regards to our Service, in the first instance please contact us at support@getaride.ng and attempt to resolve the dispute with us informally.

Incase like to dispute a Fare or any other charge, you should notify the Driver or contact us at support@getaride.ng

If we are not able to resolve a dispute informally, we will discuss and agree with you the most effective way of resolving our dispute.

 

 

Apple App Store Provisions

This clause applies where the App has been acquired from the Apple App Store. You acknowledge and agree that the Terms of Service is solely between you and GetAride, not Apple, Inc. (" Apple ") and that Apple has no responsibility for the App or content thereof. Your use of the App must comply with the App Store Terms of Service.

 

You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and (where applicable) Apple will refund the purchase price for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by the Terms of Service and any law applicable to GetAride as provider of the App.

 

You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation; and all such claims are governed solely by the Terms of Service and any law applicable to GetAride as provider of the software.

 

You acknowledge that, in the event of any third-party claim that the App or your possession and use of that App infringes that third party’s intellectual property rights, GetAride, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required by the Terms of Service.

 

 

You and GetAride acknowledge and agree that Apple, and Apple’s subsidiaries, are third- party beneficiaries of the Terms of Service as relates to your license of the App, and that, upon your acceptance of the terms and conditions of the Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms of Service as relates to your license of the App against you as a third-party beneficiary thereof.

 

Google Play Store Provisions

This clause applies where the App has been acquired from the Google Play Store.

 

 

Electronic Communications

All communications with GetAride Limited will be done electronically whenever you use the mobile applications or send emails to us. You agree to receive communications from GetAride via email or notification within our mobile applications. All communications from GetAride Limited will be regarding your journeys or promotions that relate to our service.

Username and password

You are responsible for any bookings made using your account. GetAride LIMITED WILL NOT BE LIABLE FOR ANY COSTS INCURRED ON YOUR ACCOUNT..

 

 

Liability Disclaimer

Indemnification

You hereby agree and undertake fully and effectively to indemnify and keep indemnified GetAride Limited from and against all damages, losses, claims, demands, expenses (including legal and professional expenses), costs and liabilities caused by the GP undertaking your journey.

General

If any part of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the rest of the terms and conditions will continue in effect. If any unlawful and/or unenforceable part of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the terms and conditions will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant part of the terms and conditions will be deemed to be deleted).

Nothing in the terms and conditions will constitute a partnership, agency relationship or contract of employment between the parties.

The Agreement will be governed by and construed in accordance with the laws of England and Wales; and the courts of England will have [non-]exclusive jurisdiction to adjudicate any dispute arising under or in connection with the Agreement.
